Case filed in Bombay HC against Kiren Rijiju, Vice President for remarks against judiciary
A lawyers’ body in Mumbai has filed a Public Interest Litigation PIL against Vice President Jagdeep Dhankar and Union Law Minister Kiren Rijiju for remarks against the Judiciary and Collegium System.
In a request filed at the Bombay High Court, the Bombay Lawyers Association (BLA) has alleged the remarks by Vice President Dhankar and Kiren Rijiju have “lowered the prestige of the Supreme Court in public’.
The PIL filed by the BLA through its chairman Ahmed Abidi has sought a declaration from the high court that Dhankar and Rijiju have disqualified themselves from holding the constitutional post allegedly expressing a lack of faith in the Constitution of India.
The PIL has accused the Vice President and the Law Minister of “launching a frontal attack” on the judicial system including the Supreme Court by insulting these institutions using “derogatory language” without using any constitutional recourse to change the status quo as per the law laid down by the Supreme Court.
It also stated that no action has been taken against the Rijiju and Dhankar despite their “frontal attack” on the Constitution and Judiciary.

The PIL called on the high court to restrain Rijiju and Dhankar from discharging their duties.
Law Minister Kiren Rijiju, who has been critical of the Collegium system, said in November last year that he has to work with the present system until the government comes up with an alternative mechanism, stating that the Collegium system of appointing judges is ‘opaque’ and ‘not accountable’.
In January, Vice President Dhankar, in his comments on Supreme Court’s landmark judgment in the Kesavananda Bharati case wherein it has barred the Parliament from altering the basic structure of the Constitution, said: “It will be difficult to answer the question ‘are we a democratic nation.”
